Please read this disclaimer carefully before participating in the Midsummer Slam Homerun Derby Event ("the Event") with prizes. By registering for and participating in the Event, you acknowledge and agree to the following terms and conditions:

1. Event Organizer: The Event is organized by Simply Seattle, and any reference to "we," "us," or "our" in this disclaimer refers to the Event Organizer.
2. Assumption of Risk: Participation in the Event involves inherent risks, including but not limited to physical exertion, the risk of injury, and the risk of damage to personal property. By participating in the Event, you voluntarily assume all risks associated with such participation and agree to release the Event Organizer from any liability for any injuries or damages that may occur during the Event.
3. Eligibility: The Event is open to individuals of all skill levels, aged 18+. However, participants under the age of 18 must obtain consent from a parent or legal guardian to participate.
4. Compliance with Rules: Participants must adhere to all rules and regulations set forth by the Event Organizer. Failure to comply with these rules may result in disqualification from the Event and forfeiture of any prizes.
5. Prizes: The Event offers prizes to participants based on their performance. However, the availability, nature, and value of the prizes may be subject to change without prior notice. Prizes are non-transferable, and no cash alternative or substitutions will be offered.
6. Event Modifications or Cancellations: The Event Organizer reserves the right to modify or cancel the Event at any time, for any reason, without prior notice. In the event of a cancellation, the Event Organizer shall not be liable for any losses, damages, or expenses incurred by participants.
7. Image and Likeness Release: By participating in the Event, you grant the Event Organizer the right to use your name, likeness, voice, and image in any photographs, videos, or promotional materials related to the Event, without further compensation or permission.
8. Indemnification: You agree to indemnify, defend, and hold harmless the Event Organizer, its officers, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising out of or in connection with your participation in the Event.
9. Governing Law: This disclaimer shall be governed by and construed in accordance with the laws of Washington State, without regard to its conflict of laws principles.

By participating in the Wiffle Ball Home Run Derby Event, you acknowledge that you have read, understood, and agreed to the terms and conditions stated in this disclaimer. If you do not agree with any of these terms, please refrain from participating in the Event.
